On August 17, 2018, Uzbekneftegaz JSC together with the Ministry of Justice of the Republic of Uzbekistan held a seminar on the theme ‘Improving the quality of rule-making process in the oil and gas industry.’
Senior officials of the Ministry of Justice of the Republic of Uzbekistan, Uzbekneftegaz JSC, Uztransgaz JSC, Uzneftegazdobycha JSC, Uznefteproduct JSC, Uzneftegazmash JSC, Uzburneftegaz JSC, UzLITIneftegaz JSC and Neftegazinvest LLC attended the event.
Mr. Safarov, senior consultant of the Ministry of Justice of the Republic of Uzbekistan reported on the main regulatory and legal acts governing the process of developing and preparing draft regulatory legal acts, as well as gave explanations on the development of draft documents, including:
- Resolution of the President of the Republic of Uzbekistan No. 3161 of 28 July 2017 ‘On approval of the Regulations of the Office of the President of the Republic of Uzbekistan’;
- Resolution of the Cabinet of Ministers of the Republic of Uzbekistan No. 62 of 14 February 2005 ‘On the Regulations of the Cabinet of Ministers of the Republic of Uzbekistan’;
- Order of the Minister of Justice of the Republic of Uzbekistan No. 83 of 9 April 2012 ‘On approval of the methodology guidelines on the procedure for preparing and legal-technical arrangement, as well as carrying out expert examination of draft legal acts, submitted by state and economic authorities, local government authorities to the Cabinet of Ministers of the Republic of Uzbekistan’ and other legal acts.
Mr. Abdurakhimov, head of the Legal Department, Uzbekneftegaz JSC, briefed the attendees on the essence and significance of the norms of the Decree of the President of the Republic of Uzbekistan No. 5505 of 8 August 2018 ‘On Approval of the Concept for Improving Regulatory Activity.’ He also noted that the Decree of the President of the Republic of Uzbekistan identifies the key focus areas of improvement of regulatory activity, including the improvement in quality of the processes of developing and adopting legal acts, as well as the improvement in monitoring their implementation.
In addition, Mr. Abdurakhimov reminded about the need to comply with internal documents, including the order of Uzbekneftegaz JSC No. 232 of 30 December 2015 ‘On measures for further improvement of the process of preparing and agreeing on draft regulations and local acts of Uzbekneftegaz NHC and other local acts.’
While closing the seminar, speakers noted the need for responsible officers to take a careful approach to the development of draft regulations, conduct a study to assess the impact of draft regulations, and conduct their proper financial, economic, and legal analysis.
